Employment contracts

All employers must provide employees with contracts of employment in Serbia, as it is a legal requirement. Any contract must clearly state all relevant details of employment such as benefits, working hours, compensation, and so on. Salaries and wages need to be shown in the Serbian dinar, the local currency, and the contract should be written in Serbian or a bilingual version.

Probation period

Probationary period – maximum duration of probationary period is 6 months. Both employer and employee can terminate the employment in probationary period with a 5 days notice.

Time off, leaves

Employees in Serbia are entitled to a minimum of four weeks (20 days) of paid vacation leave each year, and two weeks have to be taken in one block. Two weeks can be taken in a calendar year, while the rest can be carried over to the next year and used by June, 30. Employees can increase the number of vacation days for all employees or set criteria for increase (years within company, number of children, etc.) that each employee needs to meet in order to gain additional vacation daysEmployers can give unlimited unpaid time off to employees upon their request, depending on the reason. Granting unpaid time off is solely on the employer. Employees are entitled to 5 paid days off (in total) in case of the marriage, wife’s giving birth,  severe illness of immediate family member, and other instances se in general act.

In addition, employees receive 5 days off in case of a death of an immediate family member and two days of leave if the employee is voluntarily donating blood.

Paid sick leave can be used for as long as you need it, as long as you have a doctor’s certificate, which you must file with the health insurance administration. Employees receive 65 percent of their income for sickness/injury not linked to work for the first 30 days, and 100 percent if it is connected to work. Sick leave is covered by the employer for the first 30 days, while the government cover the costs of sick leave exceeding 30 days.

Maternity/paternity Leave

Employees receive maternity leave that equates to a total of 365 days. Following the birth of a third child, the duration extends to a total of 24 months of leave. Leave may begin at a maximum of 45 days and no less than 28 days before the expected due date.

The father/partner is entitled to five days of paternity leave after the child’s birth. The employee is only entitled to the paid entitlement in exceptional circumstances.

Employment termination

Employers must provide a written warning with explanation and evidences on reasons for termination and at least eight days period for employee to reply.  The explanation must include the cause for dismissal, supporting documentation, and a chance for the employee to react. Failure to follow the procedure may result in the dismissal being declared invalid by a court.

Termination notice period

– 8 to 30 days depending on the years of service, due to bad performance

– Maximum of 30 days notice in case of termination by employee

– No other notice periods set

Severance pay

Severance pay of at least 1/3 of regular salary for each year worked is required in the event of layoffs and  1/4 monthly salary per year of service for each year after. The severance is only paid in case employees are made redundant, not in case of termination for cause.

General working schedule

In Serbia, the standard work week is 40 hours spread over five days and cannot be less than 36 hours per week.

Overtime hours are limited to four per day and eight per week, and employees are compensated at 126 percent of their standard hourly rate for overtime hours worked. On a public holiday, employees are compensated at 110% of their standard rate. Employers are required to keep track of all overtime hours worked.

Employees who work between 10 p.m. and 6 a.m. on a regular basis are compensated at 126 percent of the standard hourly rate. A worker must consent to working nights for a period of more than one week.

Employee benefits

Serbia has a universal healthcare system. There is an option of purchasing private health insurance.

Mandatory benefits postulated by law include a probationary period, pay on annual leaves, public holidays, sick leaves, maternity leave, paternity leave, and overtime pay. Statutory benefits also include social security benefits.

At least once a month. The most common pay cycle is up to the 5th of a month for the work provided in the previous month. But this can vary, and employees can be paid at the end of the month.
